Control and Inspection in Environmental Protection

Control mechanisms as a guarantee of legality belong among the most important instruments of environmental law enforcement, in both general and specific areas of environmental protection. The section aims at exploring the meaning, function and content of various control, inspection and compliance monitoring mechanisms and measures employed in environmental protection, and their position in international, European and national law. We especially welcome the contributions dealing with competences of the key players equipped with control and inspection competences such as representative bodies, official authorities, courts, audit offices, municipalities or ombudsman. Furthermore, contributions may cover legal aspects of inspections carried out on the basis of the public initiative, or even focus on specific legal questions of international courts' decision making. The main goal of the section is to enable professional debate, which should help to identify the strengths and weaknesses of legal regulation of control and inspection mechanisms at national and international level, and provide proposals de lege ferenda.
