The Owner and Entrepreneur vs. Environmental Protection

The environment is a space where property rights and various entrepreneurial activities are carried out. Public interest in environmental protection substantiates public and private law restrictions of owners and entrepreneurs in realization of their rights. Such restrictions are often perceived as unnecessary burden and obstacle to economic development by many. On the other hand, unfavourable conditions of environmental components indicate that current regulation is insufficient and ineffective and/or it is not effectively enforced. The section of the conference is devoted to the analysis of legal tools applicable to create the balance between the right to carry out proprietary and entrepreneurial activities and legal duties which the owners and entrepreneurs must comply with. The analysis can come out of constitutional law, civil and public laws at national law levels, and/or it may concentrate on international and European law aspects. Contributions dealing with consequences of illegal behaviour related to environmental protection are also welcome. Therefore, this section of the conference is open to contributions of all legal disciplines which are focused on the role and balance of legal regulation enabling and - on the other side - restricting the property rights and the right to carry out entrepreneurial activities related to the environment.
