Judicial system and courts in historical context

(Department of the History of the State and Law)

Every year that ends with “3“ reminds us of three important procedural laws of 19th century which were appplied within the Czech countries:very important, although a bit overlooked, 1803 Austrian Criminal Code covering both substantial and procedural criminal law, 1853 Criminal Procedure Act and 1873 Criminal Procedure Act. With respect to this, we have chosen system of justice and judicial proceedings as a section topic for this year. Romanists, medievalists, legal historians dealing with recent legal history as well as our colleagues focusing on positive law are welcome to bring their contribution to this section - regarding system of justice or judicial proceedings either within our country or elsewhere in the world.

Elections, mainly presidential

This year is a great opportunity to reflect the first direct presidential elections in the Czech Republic as well as parliamentary elections in Slovakia last year. Furthermore, we can get ready for the next presidential elections in Slovakia as well as for election year 2014 in the Czech Republic.These topics together with limitations of active and passive election rights, competences of - directly elected - president of the republic, strong majoritarian governments in Slovakia and Hungary will make an interesting and coherent frame for the conference.

Interaction of private and financial law

Re-codification of private law in the Czech Republic raises a number of problematic issues and legislative entry relating to the relationship between private industry and finance. Establishment, implementation and termination of financial relations, is in many moments predicated on the existence of parallel primary relationships and behaviors that have their origin in the plane of private law. Do metologie financial law and natural elements permeate own methods of private law, especially in the field of taxation and legal control of public expenditure, but also in other areas, the implementation of public financial activities.

Right on Maintenance vs. Obligation to Maintain

Trade in Goods - its Regulation in International Law and Common Commercial Policy of the EU

(Department of International and European Law)

The section covers all the regulation of international trade in goods in international public law and law of the European Union, in particular, the common commercial policy of the EU and the law of WTO. In particular, bilateral and multilateral treaties regulating the trade in various kinds of goods (like agricultural products, cultural goods, weapons etc.) may be subject of contributions as well. Other preferred topics are those related to sanctions and retaliatory measures in international trade (embargos etc.). The topic on other hand does not cover international trade in services, investment issues and the regulation of matters which are related to private law (for example CISG and others).

The New Czech Civil Code from the Perspective of International Commercial Transactions

For many years, reform of the Czech private law has been the focal point of many debates among Czech legal experts. Legislation in the New Civil Code has been analyzed from the perspective of existing rules and provisions, continuity of development of the Czech private law system or particular legal terms and problems. Aim of this section is to provide further analysis of the New Civil Code provisions, namely in the view of international commercial transactions.

Contractual obligations with international element constitute the core of international commercial law. The New Civil Code will become one of the legal sources for international commercial transactions. The New Civil Code regulates in detail substantive issues of private law contractual legal relationship, from its conclusion to its end. Due to the possible of use of its provisions in these legal relationships those should be analyzed from the perspective of other legal sources of international, European Union or non-state origins. The aim of this section is therefore to offer new interconnection between the New Civil Code and other sources of law, e.g. the United Nations Convention on Contracts for the International Sale of Goods, UNIDROIT Principles of International Commercial Contracts, Common European Sales Law and others. Organizers of this section accept also contributions from the conflict of laws area.
